Judge could recommend new trial for Henderson
03:49 PM CST on Wednesday, November 19, 2008
A deatrow inmate from Pflugerville could get a new trial. A hearing began this week to determine if Cathy Lynn Henderson will get a new trial.
Henderson is the babysitter who abducted, killed and then buried 3-month-old Brandon Baugh in 1994.
Recently, the court of criminal appeals ordered that a hearing be held to determine if any newly discovered evidence exists that would warrant a new trial.
Henderson's lawyers say new tests show Brandon may have fallen from Henderson's arms and was not intentionally smashed against a wall or floor.
The defense and prosecution will call expert witnesses over the next several weeks.
Sometime in January, Judge Jon Wisser will recommend to the court of criminal appeals whether Henderson should have a new trial.
